Minimum of 12 deliveries
These terms and conditions govern your agreement with Colonna Ltd for a capsule machine subscription (the “Subscription”). By choosing to purchase the Subscription you accept these supplementary terms and conditions, in particular the 12 payment subscription term (the “Term”). These supplementary terms apply in addition to the Terms of Service, which can be viewed at colonnacoffee.com/pages/terms-of-service.
1.1 Your Subscription has a fixed cost which will be charged to you through a Recurring Fee. The Recurring Fee is a fixed fee which varies depending on the type of subscription you select and the frequency of its delivery.
1.2 The first Recurring Fee will be payable at the time you sign up to the Subscription. The Recurring Fee may be paid by debit/credit card. The subsequent Recurring Fees will be payable at the frequency selected when your Subscription was activated.
To ensure that your credit, debit or charge card is not being used without your consent, we reserve the right to validate name, address and other personal information supplied by you during the order process against appropriate third party databases. We also reserve the right to perform a credit check. By accepting these supplementary terms and conditions you consent to such checks being made. In performing these checks personal data provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information.
3.1 When you purchase a Subscription, you agree to pay the Recurring Fee each month for the Term of 12 payments.
3.2 Provided you pass our security and credit checks, and if you included a coffee machine with your subscription, the coffee machine that goes with your subscription will be dispatched upon receipt of your first Recurring Fee in cleared funds.
4.1 You have the right to change your mind and cancel your Subscription, without giving any reason, within 14 days of the day your Subscription being activated.
4.2 If you purchased a coffee machine with your Subscription, you also have the right to change your mind and return your unused machine without giving any reason, within 14 days of the day your subscription being activated.
4.3 To exercise your right you must inform us of your decision by a clear statement during the Cooling Off Period. Please contact our Customer Support Team via email at firstname.lastname@example.org
4.4 If you cancel your Subscription during the Cooling Off Period, we will repay to you all payments received from you, including delivery charges.
4.5 We will repay you using the same method of payment as you used to pay us. You will not incur any fees as a result of the repayment.
4.6 You must send back the unused coffee machine and any capsules that you have received, or that were in transit at the time you notified us that you were exercising your right to cancel. We will make the repayment without undue delay, and in any event no later than 14 days after we have received the coffee machine and any capsules back from you, or, if earlier, 14 days after you provide evidence that you have returned them. If you cancel before you have received the coffee machine or any capsules, we will repay you within 14 days of the date you inform us that you are cancelling the Subscription. We may withhold repayment until we have received the unused coffee machine and any capsules back from you.
5.1 The Subscription will continue for as long as you continue to make your Recurring Fee payments. It can be terminated by sending an email confirmation to email@example.com at any time after the initial 12 Recurring Fee payments, without any penalties to you.
5.2 If your Subscription is for coffee (and does not include a machine), you can terminate at any time during the Term without penalty.
6.1 If your Subscription is for coffee (and does not include a machine), you can terminate at any time during the Term without penalty. You may do so by logging into your Colonna Account or by contacting our Customer Support Team via email at firstname.lastname@example.org.
6.2 If you have included a machine as part of your Subscription and wish to terminate your Subscription before the end of the initial 12 Recurring Fee payments, you may do so by contacting our Customer Support Team via email at email@example.com. If you terminate before you have paid all 12 Recurring Fee payments, you will be required to pay a Termination Fee.
6.2.1 The Termination Fee will be the full retail price of the machine included with your Subscription at the time of termination. (£95 for the OPAL One capsule machine). You will not be entitled to a refund for any Recurring Fees already paid at the date of termination.
6.3 This does not affect your statutory right to cancel your Subscription or return your unused coffee machine within 14 days of the Subscription activation or receipt of the coffee machine.
If you fail to pay the Recurring Fee when due, Colonna’s system will reattempt collection until successful for three consecutive days. Any outstanding balance will be carried forward such that the next payment will be for the previous and current Recurring Fee payments. Colonna Ltd will freeze access to your Colonna account after two failed Recurring Fee payments until such payment is made. If payment is still outstanding 60 days after the Recurring Fee was due, Colonna Ltd may treat this as your giving notice of termination. You will have to pay the appropriate Termination Fee as set out at 6.2 above if the termination takes effect before the end of the Term.
8.1 Subscriptions will automatically remain active after the end of the Term, at the selected frequency.
8.2 If a coffee machine was included with your Subscription, it will be yours to keep.
Customers must be at least 18 years old. There is a limit of one Subscription per person.
Colonna reserves the right to change the subscription terms and conditions periodically and at our discretion. We will provide appropriate notification to subscribers affected by any such change.
